These Terms and Conditions ("Terms") govern your access to and use of the BuyMeCryptoCoffee website, platform, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and all policies referenced herein. If you do not agree to these Terms, do not access or use the Services.

We reserve the right to modify these Terms at any time. When we do, we will update the "Last Updated" date above. Your continued use of the Services after any changes indicates your acceptance of the revised Terms.

Non-Custodial Tipping: BuyMeCryptoCoffee provides a decentralized, Solana-based tipping infrastructure, allowing users to send and receive cryptocurrency tips directly via their own Solana wallets.

No Custody of Funds: We do not hold, manage, or control your funds or your private keys at any time. All transactions are conducted on the Solana blockchain; once initiated, they cannot be reversed, modified, or canceled by us.

Minimal Content Restrictions: We permit a wide range of content, except for explicitly illegal content (e.g., child sexual abuse materials, promotion of terrorism, harassment, or other unlawful activity). You must not use our Services to distribute, promote, or solicit any unlawful material or activity.

Age & Legal Capacity: You affirm that you are of legal age (18+ or the age of majority in your jurisdiction) and possess the legal authority to enter into these Terms.

Local Law Compliance: You are solely responsible for ensuring that your use of the Services is legal in your jurisdiction. We make no representations regarding the legality of accessing or using the Services in any given territory.

No KYC:We do not perform "Know Your Customer" (KYC) checks. You are solely responsible for determining and complying with any identification or verification requirements that may apply in your jurisdiction.

Self-Custody: Since BuyMeCryptoCoffee is non-custodial, you retain full responsibility for managing your private keys and wallet security. We are not liable for any loss, theft, or compromise of your wallet credentials.

Prohibited Content:

• Illegal material (including child pornography, extremist propaganda, etc.).
• Direct threats or incitement of violence.
• Content that violates any applicable law or regulation.

Responsibility for User Content: You are solely responsible for any content you create, post, transmit, or display via the Services. We do not pre-screen or endorse user-generated content.

No Guarantee of Removal: We generally do not remove or deplatform content unless it is explicitly illegal under applicable law. However, we reserve the right (but do not assume the obligation) to remove or block access to content that we determine in our sole discretion violates these Terms.

Transaction Irreversibility: Blockchain transactions (such as Solana-based transfers) are irreversible once broadcast to the network. If you make an error (e.g., sending funds to the wrong address), it cannot be undone by us.

Market Volatility: Cryptocurrency values are volatile. We are not responsible for any changes in market value that may impact tips, donations, or transactions on our platform.

No Financial Advice: BuyMeCryptoCoffee does not provide investment, legal, or tax advice. Any information on the Services is provided solely for general informational purposes.

Network Issues: We have no control over the Solana network (or any other blockchain network). We are not liable for any losses resulting from transaction delays, network congestion, forks, or other network disruptions.

No User Data Storage: We do not store personally identifiable information (PII) or private wallet data. Any information you provide (e.g., a username or display name) is stored on a minimal basis for functionality but does not include sensitive personal data.

Blockchain Transparency: Blockchain transactions are public and traceable. Any transaction you initiate or receive via our Services on Solana is visible to anyone who views the Solana blockchain. You acknowledge that BuyMeCryptoCoffee cannot remove or hide such on-chain data.

Third-Party Tools: Our Services may include links to or integrations with third-party sites or tools. We make no guarantees regarding their data practices, and you agree that any data you provide to third parties is at your own risk.

Platform Fees: If we charge or introduce any fees for certain features, we will disclose them separately. You acknowledge that Solana blockchain transaction fees (e.g., gas fees) apply independently of BuyMeCryptoCoffee.

No Refunds: All cryptocurrency transactions are final, and no refunds will be facilitated by BuyMeCryptoCoffee. You must ensure you are sending to the correct recipient address.

Services "As Is":We provide the Services on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Guarantee of Availability: We do not guarantee the uninterrupted or error-free operation of the Services. Maintenance, upgrades, or unforeseen disruptions may occur.

Security: While we aim to maintain a secure environment, we cannot guarantee the Services will be free from hacking, malware, or other unauthorized access. You are solely responsible for implementing safeguards on your devices and wallets.

No Liability: In no event shall BuyMeCryptoCoffee, its affiliates, or its officers, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or in connection with your access to or use of (or inability to use) the Services.

Cap on Liability: If a jurisdiction does not allow a complete exclusion of liability, our total liability to you for all claims arising out of or relating to these Terms or the Services shall in no event exceed the amount of fees (if any) you paid to BuyMeCryptoCoffee in the six (6) months preceding the event giving rise to the claim.

Cryptocurrency Risks: You acknowledge the inherent risks in using crypto-based systems (e.g., volatility, technical failures, regulatory scrutiny). We bear no responsibility for any losses or damages resulting from these risks.

Termination by BuyMeCryptoCoffee: We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, for any or no reason, including a breach of these Terms.

Termination by User: You may discontinue use of the Services at any time. However, any blockchain transactions, tips, or content you have already placed on the Solana blockchain are irreversible and remain publicly accessible via the Solana ledger.

Survival: Sections pertaining to Disclaimers, Limitation of Liability, Indemnification, and any others that by their nature should survive termination will remain in effect after termination.

Governing Law: These Terms are governed by and construed in accordance with the laws of Hungary, without regard to conflict-of-law principles.

Dispute Resolution: Any disputes arising out of or relating to these Terms or the Services shall be resolved individually, without resort to any form of class action, through [binding arbitration / courts of the Governing Law jurisdiction], as applicable.

Class Action Waiver: To the extent permissible by law, you waive any right to pursue disputes as part of a class, consolidated, or representative action.

Global Accessibility: Our Services may be accessible worldwide but we make no representation that using our platform is lawful in every jurisdiction. You are responsible for ensuring compliance with all local rules and regulations.

Sanctions and Export Control: You represent and warrant that you are not located in, or a citizen of, any country embargoed or sanctioned by Hungary nor are you on any restricted party list.

Entire Agreement: These Terms, along with any referenced policies, constitute the entire agreement between you and BuyMeCryptoCoffee, superseding any prior agreements.

Severability: If any provision of these Terms is deemed unlawful or unenforceable, the remaining provisions remain in full force and effect.

No Waiver: Our failure to enforce any provision shall not be deemed a waiver of that provision or any future enforcement.

Assignment: BuyMeCryptoCoffee may assign or transfer these Terms, in whole or in part, at its sole discretion without notice. You may not assign or transfer any rights or obligations under these Terms without our prior written consent.

Headings: Section headings are for convenience only and have no legal or contractual effect.
